TERMS AND CONDITIONS OF HIRE

  1. DEFINITIONS

  2. 1.1 "Client" means the person or entity hiring Sip & Clink's mobile cocktail bar.

  3. 1.2 "Hire Period" means the agreed period of time during which Sip & Clink's mobile cocktail bar will be provided to the client.

  4. 1.3 "Mobile Cocktail Bar" means Sip & Clink's mobile cocktail bar and all its equipment and accessories.

  5. HIRE

  6. 2.1 Sip & Clink agrees to hire the Mobile Cocktail Bar to the Client during the Hire Period subject to the terms and conditions set out in this agreement.

  7. 2.2 The Client acknowledges that they have inspected the Mobile Cocktail Bar and that it is in good working condition at the commencement of the Hire Period.

  8. PAYMENT AND CANCELLATION

  9. 3.1 The Client agrees to pay Sip & Clink the hire fee in accordance with the payment terms and cancellation policy set out in the separate payment terms and cancellation policy document.

  10. 3.2 Sip & Clink may cancel the booking at any time prior to the commencement of the Hire Period due to circumstances beyond its control, in which case the client shall be entitled to a full refund of any amounts paid to Sip & Clink.

  11. RESPONSIBILITIES OF THE CLIENT

  12. 4.1 The Client shall provide suitable access to the venue for the Mobile Cocktail Bar and ensure that there is a suitable area for the Mobile Cocktail Bar to be set up.

  13. 4.2 The Client shall be responsible for ensuring that the venue is suitable for the Mobile Cocktail Bar and that all necessary permissions and licenses have been obtained for the Mobile Cocktail Bar to be used at the venue.

  14. 4.3 The Client shall be responsible for any damage to the Mobile Cocktail Bar or its equipment caused during the Hire Period.

  15. 4.4 The Client agrees to be liable for the full cost of repair or replacement of any equipment damaged during the Hire Period.

  16. 4.5 The Client agrees to make the Mobile Cocktail Bar and its equipment available for collection by Sip & Clink at the end of the Hire Period.

  17. LIMITATION OF LIABILITY

  18. 5.1 Sip & Clink shall not be liable for any loss, damage or injury arising from the use of the Mobile Cocktail Bar, including any loss, damage or injury arising from any defect in the Mobile Cocktail Bar or its equipment.

  19. 5.2 The liability of Sip & Clink shall be limited to the cost of repair or replacement of the Mobile Cocktail Bar or its equipment in the event of any damage caused during the Hire Period.

  20. 5.3 Sip & Clink shall not be liable for any loss of profits, business or anticipated savings or any other indirect or consequential loss arising out of or in connection with the hire of the Mobile Cocktail Bar.

  21. GENERAL

  22. 6.1 This agreement constitutes the entire agreement between the parties and supersedes all previous agreements and understandings between the parties.

By signing this agreement, the Client acknowledges and agrees to the terms and conditions of Sip & Clink's mobile cocktail bar hire service and accepts liability for any damage caused to the Mobile Cocktail Bar or its equipment during the Hire Period. The Client also agrees to make the Mobile Cocktail Bar and its equipment available for collection by Sip & Clink at the end of the Hire Period.

CANCELLATION POLICY

  1. Cancellation by the Client

  2. 1.1 The Client may cancel the booking by providing written notice to Sip & Clink.

  3. 1.2 The following cancellation fees will apply:

  • 14 days or more prior to the Hire Period: No cancellation fee.

  • Less than 14 days prior to the Hire Period: 50% of the total hire fee.

  • Less than 7 days prior to the Hire Period: 100% of the total hire fee.

  1. Cancellation by Sip & Clink

  2. 2.1 Sip & Clink may cancel the booking at any time prior to the commencement of the Hire Period due to circumstances beyond its control, in which case the client shall be entitled to a full refund of any amounts paid to Sip & Clink.

  3. 2.2 Sip & Clink reserves the right to cancel the booking at any time if the Client fails to comply with the terms and conditions of the hire agreement.

  4. Refunds

  5. 3.1 In the event of cancellation by the Client, Sip & Clink will refund any amounts paid by the Client, less the applicable cancellation fee as set out in clause 1.2.

  6. 3.2 Refunds will be made within 14 days of receipt of written notice of cancellation from the Client.

  7. Changes to the Booking

  8. 4.1 Changes to the booking may be made subject to availability and agreement by Sip & Clink.

  9. 4.2 Any changes to the booking may be subject to additional fees, which will be agreed between the parties.

By hiring Sip & Clink's mobile cocktail bar, the Client acknowledges and agrees to the cancellation policy set out above. The Client agrees to pay the applicable cancellation fee in the event of cancellation and acknowledges that changes to the booking may be subject to additional fees.

PAYMENT TERMS

  1. Payment Schedule

  2. 1.1 A non-refundable deposit of 50% of the total hire fee is required to secure the booking. The remaining 50% of the total hire fee is due 14 days prior to the commencement of the Hire Period.

  3. 1.2 For bookings made less than 14 days prior to the commencement of the Hire Period, full payment is required at the time of booking.

  4. Payment Method

  5. 2.1 Payment may be made by bank transfer, credit card or debit card or cash on the day with prior agreement.

  6. 2.2 Sip & Clink will provide the Client with an invoice for the deposit and final payment.

  7. Late Payment

  8. 3.1 If the Client fails to make payment in accordance with the payment schedule, Sip & Clink reserves the right to cancel the booking and retain any amounts paid.

  9. 4.1 All payments must be made in AUD (AUSTRALIAN DOLLARS) unless otherwise agreed in writing by Sip & Clink.

By hiring Sip & Clink's mobile cocktail bar, the Client acknowledges and agrees to the payment terms set out above. The Client agrees to pay the non-refundable deposit and remaining hire fee in accordance with the payment schedule and acknowledges that late payment may result in the cancellation of the booking and the retention of any amounts paid
